These Terms of Use (“Terms”) govern your use of the Upright mobile application (“App”) published by Ali3N Studios LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Not Medical Advice; No Clinician-Patient Relationship
Upright is an educational and self-tracking companion tool for people with, or suspected of having, Postural Orthostatic Tachycardia Syndrome (POTS) and other forms of dysautonomia. The App is provided for informational and self-tracking purposes only. The App does not provide medical advice, does not diagnose any condition, does not prescribe medication, and does not establish a clinician-patient relationship.
2. The NASA Lean Test Is a Screening Tool
The NASA Lean Test result displayed by the App is a screening indicator, not a diagnosis. A positive screen warrants evaluation by a cardiologist or dysautonomia specialist. POTS diagnosis requires clinical evaluation, and a single test result does not constitute or replace such evaluation. The App applies the published threshold of a heart-rate increase of ≥30 bpm (or ≥40 bpm for individuals under 19) within 10 minutes of standing, without significant orthostatic hypotension, but interpretation of these numbers belongs to a qualified clinician.
3. Safety During the NASA Lean Test
You agree to stop the NASA Lean Test immediately if you feel faint, dizzy to the point of imminent loss of consciousness, experience chest pain, or any other concerning symptom. Sit or lie back down before continuing. Have someone nearby if possible. The App provides safety reminders, but the responsibility to stop the test rests with you.
4. Age Requirement
You must be at least 13 years old to use the App. Users between 13 and 17 should have parental or guardian awareness and supervision, particularly when sharing data with a physician. The App offers an “under 19” toggle on the NASA Lean Test to apply the adolescent diagnostic threshold; this is a clinical adjustment, not a separate user category.
5. AI-Generated Content
The AI Companion and AI test-interpretation features use Anthropic Claude via AWS Bedrock to generate responses. AI responses are not medical advice. AI outputs may occasionally be inaccurate, incomplete, or unexpected. Always defer to your prescribing clinician on medical decisions. We do not represent that AI-generated content is suitable for any particular purpose.
6. One-Time Purchase & Billing
- Upright Pro is offered as a one-time, non-consumable in-app purchase of $9.99 USD (or local equivalent). There is no subscription and no recurring charge.
- Payment is processed by Google Play Billing (Android) or Apple StoreKit (iOS), subject to the platform’s terms.
- Pro unlocks: full symptom history and pattern charts, trigger tracker with AI correlation analysis, unlimited AI Companion conversations, weekly AI symptom pattern summary, unlimited NASA Lean Test AI interpretations, the full Management Toolkit, the Physician PDF report, and cloud sync across devices.
- Refund requests should be directed to Google Play or Apple via their standard refund mechanisms.
- Pro is tied to your platform store account. Restore Purchase is available in Settings.
7. Free Tier
The App is fully functional in a free tier. The NASA Lean Test is unlimited and always free. Flare Support is unlimited and always free. The free tier also includes basic heart-rate monitoring, today’s symptom log, basic management toolkit, three AI Companion messages per month, and one free AI interpretation of a NASA Lean Test result.
8. User Conduct
You agree not to use the App to harm yourself or others, to reverse engineer or attempt to extract source code from the App, to misrepresent your age, or to share your account credentials with another person.
9. Your Content & Account Data
You retain all rights to the symptom logs, notes, journal entries, and other content you create in the App. You grant us a limited license to store, transmit, and display this content solely for the purpose of providing the App’s features (including transmitting it to AWS Bedrock for AI processing when you initiate an AI feature, and storing it in Firebase Firestore for signed-in accounts).
10. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING WITHOUT LIMITATION ANY IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, OR NON-INFRINGEMENT.
11. Limitation of Liability
To the maximum extent permitted by law, in no event shall Ali3N Studios LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App, including damages arising from reliance on any AI-generated content, NASA Lean Test result, or symptom-pattern analysis. Our total cumulative liability for any claim relating to the App shall not exceed the amount you paid us for Upright Pro, if any.
12. Termination
We may suspend or terminate your access to the App at any time for violation of these Terms or for reasons necessary to protect the integrity of the service. You may stop using the App at any time and may delete your account from within Settings.
13. Changes to These Terms
We may update these Terms from time to time. Continued use after material changes constitutes acceptance. We will surface notable changes in the App or by email where appropriate.
14. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict-of-laws principles.
