These Terms of Use (“Terms”) govern your use of the Tide mobile application (“App”) published by Ali3N Studios LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App.
1. Not Medical Advice; No Clinician-Patient Relationship
Tide is a self-tracking companion for adults living with, or exploring, bipolar disorder. The App is provided for informational and self-tracking purposes only. The App does not provide medical advice, does not diagnose any condition, does not prescribe or adjust medication, and does not establish a clinician-patient relationship. Mood logs, episode records, sleep tracking, pattern charts, AI responses, screener results, and the physician report are tools for personal reflection and for conversation with a qualified clinician — they are not a substitute for professional care.
2. Screeners Are Not Diagnoses
The App includes the Mood Disorder Questionnaire (MDQ) and the Hypomania Checklist (HCL-32). These are validated screening instruments, not diagnostic tests. A positive screen indicates only that a conversation with a clinician may be worthwhile; it does not mean you have bipolar disorder. A negative screen does not rule it out. Only a qualified clinician can diagnose a mood disorder, and only after a full evaluation.
3. The Physician Report Is a Summary, Not a Record
The App can generate a PDF summarising your self-reported data for a clinical appointment. It reflects what you entered, nothing more. It is not a medical record, it is not validated, and it should never be used as the sole basis for a clinical decision. Your clinician remains responsible for evaluating you.
4. Never Change Medication Based on This App
Psychiatric medications must be started, stopped, and adjusted only under the supervision of the clinician who prescribed them. Abruptly stopping a mood stabiliser, antipsychotic, or antidepressant can be dangerous. The App tracks adherence so you can discuss it with your prescriber. It never recommends a medication, a dose, or a change to either.
5. AI-Generated Content
AI features — mood consult, screener interpretation, weekly summaries, and communication scripts — use a large language model (Anthropic Claude) via AWS Bedrock. AI responses are general information only and are not medical advice. They may occasionally be inaccurate, incomplete, or unexpected. Nothing the AI produces is a diagnosis, a treatment plan, or a clinical judgement, and it never replaces a clinician.
6. Crisis Resources Are Third Parties, Not Our Service
The App surfaces crisis resources including the 988 Suicide & Crisis Lifeline and the Crisis Text Line. These are independent third-party services. We do not operate them, staff them, monitor them, or guarantee their availability. The App is not a crisis service and no one monitors what you enter into it. If you are in danger, contact emergency services or go to your nearest emergency department.
7. Age Requirement
You must be at least 18 years old to use the App. By using the App you represent that you meet this age requirement.
8. Subscriptions & Billing
- Tide Pro is offered as an auto-renewable subscription at $4.99 per month or $34.99 per year.
- Payment is charged to your Google Play account (Android) or Apple ID (iOS) at confirmation of purchase.
- The subscription automatically renews unless canceled at least 24 hours before the end of the current billing period.
- Your account will be charged for renewal within 24 hours prior to the end of the current period at the same price.
- Cancellation is handled by the store, not by us. Manage or cancel in Settings > Google Play > Payments & subscriptions (Android) or Settings > [Your Name] > Subscriptions (iOS).
- No refunds are provided for partial subscription periods. Refund requests must be directed to Google Play or Apple respectively.
9. Free Tier
The App is fully functional in a free tier, with a limited monthly AI quota and certain advanced features gated behind Pro. Mood logging, episode tracking, medication adherence, screeners, and the toolkit do not require payment. The free tier requires no account beyond optional cloud sync.
10. User Conduct
You agree not to:
- Use the App in a manner that violates any applicable law
- Attempt to reverse engineer, decompile, or extract source code from the App
- Use the App to harm yourself or others
- Misrepresent your age to access the App
- Share your account credentials with another person
11. Your Content & Account Data
You retain all rights to the mood logs, journal entries, notes, and other content you create in the App. By using cloud sync, you grant us a limited license to store and transmit that content to provide the service to you. We do not sell or share your content with third parties (see our Privacy Policy for the AI processing disclosure).
12. Trusted Person Shares
If you create a Trusted Person share, you are choosing to make selected summary data viewable by anyone holding that link. We cannot control what the recipient does with it. Shares expire automatically after 90 days and can be revoked at any time.
13. Disclaimer of Warranties
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED. We do not warrant that the App will be uninterrupted, error-free, or that defects will be corrected. We do not warrant any clinical outcome, any improvement in your condition, or the accuracy of any pattern, trend, or early-warning indication the App displays.
14. Limitation of Liability
To the maximum extent permitted by law, in no event shall Ali3N Studios LLC be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of or inability to use the App. Our total liability for any claim arising from these Terms shall not exceed the amount you paid for the App in the twelve months preceding the claim.
15. Indemnification
You agree to indemnify and hold Ali3N Studios LLC harmless from any claim, demand, or damages, including reasonable attorneys’ fees, arising from your use of the App or your violation of these Terms.
16. Termination
We may suspend or terminate your access to the App at any time, with or without cause. You may stop using the App at any time and may delete your account from within the App or via the Delete Account page.
17. Changes to These Terms
We may update these Terms from time to time. Material changes will be reflected by an updated date at the top of this document. Continued use of the App after changes constitutes acceptance of the revised Terms.
18. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to its conflict of laws principles. Any dispute arising from these Terms shall be resolved in the state or federal courts located in Texas.
