These Terms of Use (“Terms”) govern your use of the EyeShot mobile application (“App”), operated by Ali3N Studios LLC (“we,” “us,” or “our”). By downloading, installing, or using the App, you agree to these Terms. If you do not agree, do not use the App. These Terms supplement any general Ali3N Studios terms and our EyeShot Privacy Policy.
1. What EyeShot Is
EyeShot is a photography tool for capturing and enhancing close-up photographs of the iris and eye for artistic, creative, and personal use. The App also offers optional AI-assisted enhancement features.
2. Not a Medical or Identification Device
EyeShot is not a medical device. It is not intended to diagnose, treat, cure, or prevent any disease or condition, and it must not be used for medical assessment, iris diagnosis (“iridology”), biometric identification, or authentication. Photographs you capture are creative content, not clinical or identity records. Always consult a qualified professional for any health concern.
3. Eligibility
You must be at least 13 years old (or the minimum age of digital consent in your jurisdiction) to use the App. By using the App you represent that you meet this requirement.
4. Your Content
Photos you capture or import remain yours. You are solely responsible for the photos you create and for obtaining consent from any person whose eye you photograph. You agree not to use the App to capture images of others without their permission, or for any unlawful, harassing, or infringing purpose.
5. AI Enhancement Features
Some features send a copy of the selected image to a third-party AI processing service (Google’s Gemini API) to generate an enhanced result, as described in our Privacy Policy. These features are optional and are only used when you explicitly choose them. AI output is generated automatically and may contain artifacts or inaccuracies; you are responsible for reviewing results before keeping or sharing them.
6. Credits and In-App Purchases
AI enhancements consume “credits.” Credits may be granted on a trial basis, earned by viewing optional advertisements, or purchased through your app store. Purchases are processed by the app store, are generally non-refundable except as required by law or store policy, and are non-transferable. Credit balances have no cash value. We may change credit costs, package contents, or pricing at any time.
7. Advertising
The free version of the App may display advertisements, including optional rewarded ads that grant credits. Making a qualifying purchase removes advertisements. Advertising is provided by third parties as described in the Privacy Policy.
8. Acceptable Use
You agree not to reverse engineer, decompile, abuse, overload, or attempt to gain unauthorized access to the App or its supporting services, and not to use the App in violation of any applicable law.
9. Disclaimers
THE APP IS PROVIDED “AS IS” AND “AS AVAILABLE” WITHOUT WARRANTIES OF ANY KIND, EXPRESS OR IMPLIED, INCLUDING MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, AND NON-INFRINGEMENT. We do not warrant that the App will be uninterrupted, error-free, or that AI results will meet your expectations.
10. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, ALI3N STUDIOS LLC SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR EXEMPLARY DAMAGES, OR ANY LOSS OF DATA, ARISING FROM YOUR USE OF THE APP. Our total liability for any claim relating to the App shall not exceed the amount you paid us, if any, in the twelve months preceding the claim.
11. Changes to the App and Terms
We may update the App and these Terms from time to time. Material changes will be reflected by an updated date on this page. Continued use after changes take effect constitutes acceptance.
12. Termination
You may stop using the App at any time by uninstalling it. We may suspend or discontinue the App or any feature at any time.
